Compelling the Transfer of an Official Deed in Iran

When the seller will not transfer title: requirements, land-registry checks, mortgaged property, a deceased seller and interim orders

01

Suing for the official deed

When a sale was made with a private agreement and the seller, despite receiving the price, does not attend the notary office, the buyer can ask the court to compel the transfer. The claim rests on Articles 10 and 220 of the Civil Code and applies to real estate, cars and other assets needing an official transfer. If the seller still refuses after judgment, a court representative signs on their behalf.

The buyer must show a valid, final sale, the seller’s ownership and their own performance. A land-registry enquiry confirms ownership, mortgages and attachments. Mortgaged property must be released first; if the seller has died, the claim proceeds against the heirs.

02

Chains of sales and interim protection

Where property passed through several private sales, every link from the registered owner must be joined to the claim. An interim order or attachment can stop the seller transferring or mortgaging the property during the case. The 2024 law requiring official registration of real-estate transactions is being implemented in stages, so new deals should be registered officially from the start.

Shahin Group checks registry status, mortgages and the chain of title, files against the correct parties, secures interim orders and stays with the client until the deed is signed.
